Custo and Desigual in legal war
Desigual has responded to the plagiarism lawsuit that the Catalan designer Custo Dalmau has filed against them. The fashion company will take “all the necessary legal measurements” to what Custo considers false accusations against its company. In a press release, Desigual has “denied all accusations by Custo Dalmau” and gives no comment on the topic. The press release informs, “From the 80s, Desigual has developed a unique project with its own style and commercial strategy, which is completely differentiated with garments directed to all types of public.”
In an exclusive interview to FashionUnited last week, the CEO of Desigual Manel Adell commentated on the recurrent comparisons with Custo: “Our mixtures of patchwork and materials started in 1984. Even though many brands are inspired by us, we focus to improve and further develop our brand.”
Custo’s lawyers advised to file a lawsuit against the similarity of the collections of both brands. On the declarations published in newspaper El País, Gusto commented: “This is the first case of systematic and reiterative copy of a global project to get profit out of the creativity and the philosophy of a brand like ours. Custo was created 27 years ago like a project where the graphics forms its DNA, and mixing materials and colours.”
Custo Barcelona also accuses Desigual of following their shop openings and contacting Custo’s distributors to market its products.
